Daniela Vargas officially released by immigration officials

ICE released a statement last week saying Vargas was arrested during one of its "targeted enforcement" operations.

Last week, Ice informed Vargas's attorneys that it would pursue immediate deportation without allowing her to first have a court hearing.

But her release won't end her legal challenge to avoid being deported, said Joshua Stehlik, a supervising attorney for the National Immigration Law Center. But Vargas failed to renew her status at the end of the mandated two-year period in November.

"Court filings regarding the reason and manner of arrest and detention continue to be pursued in an effort to secure Daniela's rights", the press release says.

Daniela Vargas was released under an order of supervision, according to a press release from the law firm representing her.

Vargas is still not safe from deportation, but will be able to live outside of immigrant detention as she awaits a final decision on her case. It just means she will no longer be in a detention center.

Vargas' parents brought her from Argentina when she was 7 under a visa wavier program, which allows immigrants to enter the USA without a visa for 90 days but denies them a hearing in front of a judge if they overstay.

The Southern Poverty Law Center had accused ICE agents of targeting Vargas days later because of her comments about the agency at that day's news conference and other public events where she had spoken.

Being brought to the states at age 7 on a visa, DACA, Deffered Action for Childhood Arrival, status is now expired but her renewal application has been submitted and is pending.

Her attorney said her arrest "could be retaliation". The administration has declined to answer whether it plans to terminate the program, which Mr. Trump said he would do immediately upon taking office. Her ordeal with ICE began on February 15, when agents entered her home and took her father and brother out in handcuffs.
