Court may strike law barring sex offenders from social media

Justice Elena Kagan invoked President Donald Trump's ever-evolving Twitter account Monday as justification to strike down a North Carolina law that limits registered sex offenders from accessing social media.

Montgomery said the law is restricted to websites that allow a user to go to another user's profile page, and then link to other users they do not know.

North Carolina, meanwhile, counters its law is necessary because social media is a prime forum for child molesters to seek out and groom victims.

Kagan also noted that the law does not prohibit the use of what she perceives as the most risky websites, including those that have only chat rooms or photo-sharing.

Justice Samuel Alito, who has backed restrictions on speech more often than his colleagues, appeared to be more open to North Carolina's argument.

The Cato Institute and the American Civil Liberties Union are backing Packingham and argue that the law could prevent sex offenders from using social media to look for a job or read the news. Other states restrict Internet use as a condition of parole, or ban from social networking sites only those who commit certain crimes.

"So a person in this situation, for example, can not go onto the president's Twitter account to find out what the president is saying today?"

"The practical effect [of North Carolina's law] is to bar registered sex offenders not merely from the school, the playground, and even the town square, but from entire regions of the country where their fellow citizens are gathered for the objective of information exchange about any and all subjects of human inquiry", says a friend-of-the-court brief filed on Packingham's side by the Electronic Frontier Foundation. It has been used to convict more than 1,000 people.

North Carolina officials say the law - which also bars sex offenders from sites like Snapchat and Instagram which can be accessed by children under the age of 18 - is meant to stop predators from seeking out new victims.

A more constrained law might be constitutional, lawyer David Goldberg said on behalf of Packingham, but North Carolina's version goes too far. "[Instead it] forbids speech on the very platforms on which Americans today are most likely to communicate, to organize for social change, and to petition their government".

The case has reached the Supreme Court after a divided ruling in North Carolina's highest court.

In 2014, for instance, the 9th U.S. Circuit Court of Appeals ruled against a California law that required registered sex offenders to provide authorities with a "list of any and all internet identifiers established or used by the person".

He got a suspended sentence of 10-12 months and his name was placed on a registry of sex offenders.

Local police saw a Facebook post he wrote, which read "Praise be to GOD. WOW!" He emphasized that sex offenders subject to the law would have other alternatives, such as podcasts, blogs and The New York Times.

Throughout the arguments, multiple justices noted the amicus curiae - or, friend of the court - brief filed in the case by the Electronic Frontier Foundation, which argued that the state's ban could be applied to "any commercial website that allows access to minors and permits users to post comments under their own name or nickname that other users may see and respond to in order to exchange information about an article, product, or service".

The case at issue stems from a challenge by Lester Gerard Packingham, who was arrested for dating a 13-year-old when he was 21.
