USA judge rejects tribes' latest effort to stop Dakota Access pipeline progress

The tribe, along with the Standing Rock Sioux, has opposed Energy Transfer Partners' plan to route the pipeline beneath Lake Oahe, a reservoir on the Missouri River that provides drinking water and is held sacred by the Sioux.

Chase Iron Eyes, member of the Standing Rock Sioux and law project attorney, said the decision was disappointing, not surprising.

Work is underway. U.S. District Judge James Boasberg is to hear arguments this afternoon on whether it should be stopped while the lawsuit plays out.

The Standing Rock and Cheyenne River tribes asked for a temporary injunction against construction, pending a lawsuit against the pipeline.

The Cheyenne River Sioux joined an action filed in July by the Standing Rock Indian Reservation, which sought to block the project over concerns about water contamination and destruction of cultural sites.

A federal judge in Washington, DC has dismissed a request by a group of Native American tribes seeking to stop construction of the final link of the controversial Dakota Access Pipeline.

In the motion, the tribe argued that the construction of a pipeline and flow of oil beneath Lake Oahe obstructs the free practice of the tribe's religion, Matt Vogel, a legislative associate for the Cheyenne River Sioux, told reporters on a conference call on Monday.

Texas-based Energy Transfer Partners received final approval from the Army last week to lay pipe under a Missouri River reservoir in North Dakota and complete the 1,200-mile pipeline, which would move North Dakota oil to a shipping point in IL. Last week, the U.S. Army Corps of Engineers announced that the Dakota Access Pipeline easement would be granted. Some have been here since April, their numbers fluctuating between hundreds and thousands, in an unprecedented show of joint resistance to the almost 1,200 mile-long Dakota Access oil pipeline. The easement granted by the Army Corps allows the developer to finish building the 1,172-mile pipeline carrying crude oil from North Dakota to IL.

A quick court hearing proved that those concerned about the ability to secure a restraining order in the Dakota Access Pipeline case were right to be anxious.

Boasberg ruled that construction of the pipeline doesn't threaten the water and said he wouldn't issue a restraining order against the project. Judge Boasberg unceremoniously denied the Native American tribes' legal request with little time wasted.

Construction on the pipeline had stalled for months due to opposition from protesters.

Iron Eyes said the corps told him it will follow up its February 22 deadline to vacate the Oceti Sakowin camp by coming in after that date to remove any remaining structures.
