Facebook, Google face strict European Union privacy rules that could hit ad revenues

Yves Schwarzbart, head of policy and regulatory affairs at the Internet Advertising Bureau (IAB) told Reuters, the Commission's new proposals will particularly hit tech companies that have difficulties directly talking to their end users.

The ePrivacy bill also includes new rules that require internet browsers to ask users for permission to track their online behaviour, offer options that collect different amounts of data and remind them every six months that it is being gathered.

In order to try and clear up the legal framework around digital communications, the EU's operating arm, the European Commission, has proposed new rules that will require no individual consent is needed for non-privacy intrusive cookies such as for shopping cart history or filling in online forms over several pages.

Current online services and communications apps now don't follow the same privacy rules that apply to telecom operators, but the EC believes they should.

In other words, electronic communications providers would be required to ensure the confidentiality of their customer's conversations and to obtain their consent before tracking their online activities to display personalized advertising.

The European Commission has now tasked the European Parliament and the Council to adopt the proposals by 25 May 2018, the same time the GDPR is applied. The EU wants online message services to be subject to the ePrivacy Directive to help improve confidentiality and security.

The European Commission wants to tighten the rules for the processing of personal data from electronic services such as WhatsApp, Facebook Messenger, Skype, Gmail, iMessage and Viber.

The latter recently announced it was taking the Chinese department store Intime Retail private in a $2.6 billion deal. Yahoo came under intense pressure when it reported two massive breaches in its extensive database a year ago .

Andrus Ansip, vice-president for the digital single market said: "Our proposals will deliver the trust in the Digital Single Market that people expect". The high level aim of the draft e-Privacy Regulation is to harmonise the specific privacy framework relating to electronic communications within the European Union and ensure consistency with the GDPR. "New rules will allow users to be more in control of their settings, providing an easy way to accept or refuse the tracking of cookies and other identifiers in case of privacy risks".

The EC also proposed that privacy be guaranteed for content of communication as well as metadata such as who was called, the timing, location and duration of the call, as well as websites visited.

On the other hand, the EC points out that the stricter rules could also open up some new business opportunities for traditional telecoms operators.

Under an EU-US Privacy Shield adopted past year, companies face penalties if they do not meet EU standards of protection.

Spam electronic communications will also be banned, and marketing calls will be required to show their phone number or an easily identifiable prefix so users are aware of its goal.

The commission is seeking to create a digital single market for data for the world's biggest free-trade bloc of around 500 million people.
