US Family Sues Apple, Blames FaceTime for Fatal Crash

Apple's FaceTime app is the target of a civil lawsuit filed in Santa Clara County, California Superior Court last week in connection with a 2014 accident that happened in Dallas where a 5-year-old girl was killed.

There is no call or FaceTime that is more important than focusing on driving.

The parents were with their two children, Moriah, 5, and Isabella, when the accident happened on December 24, 2014 in Texas.

The case dates back to 2014 when Moriah was travelling in the back of her parents' auto near Dallas and was hit by another vehicle driven by Garrett Willhelm who was using the Apple "FaceTime" while driving.

The lawsuit argues that since Apple knew that there was a risk that a driver would one day use the iPhone while driving and that there was a danger of a vehicle accident, that Apple breached its duty of care to the plaintiffs by not designing the iPhone 6 Plus to be safe, meaning that it is just as liable for the accident as Wilhelm.

Drones would then fly around the airship, pick up the items needed for delivery, and deliver those items to the customer's home. The filing was unearthed CB Insight analyst Zoe Leavitt who described the structure as the " Death Star of ecommerce ".

The lawsuit claims that statistics like this, showed that Apple understood the risks, however it still did not implement the feature when it launched the iPhone 6 Plus in September 2014.

The failure of Apple to use Global Positioning System tracking to detect the speed of the vehicle in which a user was travelling and shut down the "FaceTime" app was a significant factor in the accident, the family added. According to a suit filed on December 23, 2016, another driver struck the Modisette's family auto at full highway speed (65 mph) from behind, causing extensive damage to the Toyota sedan. That caused the family vehicle to be "propelled forward, rotate and come to a final rest at an angle facing the wrong direction in the right lane of traffic", Wilhelm's auto then "continued its trajectory by rolling up and over the driver's side of the Modisette vehicle", the lawsuit detailed.

Wilhelm-whose FaceTime app was still active when officers arrived on the scene, say police-now faces a manslaughter charge.

"At the time of the collision in question, the iPhone utilised by Wilhelm contained the necessary hardware (to be configured with software) to automatically disable or "lock out" the ability to utilise Apple's "FaceTime" application".

As for Mr. Wilhelm, his attorney disputes the facts alleged in the lawsuit, and argues that "the use of a cellular device did not contribute [to the incident]" and that "it was simply an accident".
