Texas Judge Issues Nationwide Injunction on Federal Transgender Health Mandate

According to District Judge Reed O'Connor, the rule defines sex bias to include "discrimination on the basis of gender identity and termination of pregnancy".

The injunction was approved Saturday, just one day before the new policy was to take effect. The plaintiffs in the case object that the rule forces "them to perform and provide insurance coverage for gender transitions and abortions, regardless of their contrary religious beliefs or medical judgment".

"All Americans - regardless of their sex, gender identity, or sexual orientation - should have access to quality, affordable healthcare, free from discrimination". The ruling comes in response to suits brought by several states regarding section 1557 of the laughably named "Affordable" Care Act.

That injunction followed a May letter from U.S. Department of Justice and the U.S. Department of Education stating that the federal agencies "treat a student's gender identity as the student's sex for purposes of Title IX and its implementing regulations". "Today's ruling ensures that doctors' best medical judgment will not be replaced with political agendas and bureaucratic interference".

It's the second ruling by O'Connor this year that thwarts President Barack Obama's efforts to increase protections for transgender individuals at a time when they are being hotly debated across the country.

O'Connor's ruling is a victory for Texas Attorney General Ken Paxton, who led the fight against the Obama administration's new guidelines.

The court order, brought by the states of Texas, Wisconsin, Nebraska, Kansas, Louisiana, Arizona, Kentucky, and MS, along with three Christian-affiliated groups, stated that the Health and Human Services department's regulations prohibiting doctors from discriminating on the basis of gender identity, or against women seeking abortions, violated practitioners' religious freedom. The same federal judge who stopped enforcement of Obama administration's transgender guidance for schools stopped enforcement of a similar healthcare rule on Saturday.

Lori Windham, senior counsel at Becket Law, praised the O'Connor's decision against the rule barring anti-trans discrimination as "a common-sense ruling".

[The rules place] substantial pressure on Plaintiffs to perform and cover transition and abortion procedures.

"The order does not change the fact that federal law bans gender-based discrimination", Keisling said.

Windham told CP in an email on Monday that fears that religious doctors and health care providers could be forced to provide services that they are opposed to is very real despite arguments from the opposition.
